Lease Registration


The Land Registration Act 2002, which came into force on 13 October 2003, has many implications for commercial landlords and businesses occupying properties under commercial leases.

One of the major changes after 13th October 2003, all new leases with terms over 7 years or existing leases sold or assigned with 7 years left to run must now be registered with Land registry. Not only will the property acquire its own leasehold title number but it will be noted on the Landlord’s freehold title. This will bring many more High Street shops, cafés, restaurants, industrial units and offices onto the Register.

There are two stages to this process - the first stage is called the 'design' stage and this need to be completed and submitted to your Building Control Body or Approved Inspector at the same time as your Building Control Application. The second stage is called the 'as-built' stage and this occurs when the build is complete and a Certificate of compliance will need to be produced and issued to the building control officer. We offer guidance and recommendations as to the most appropriate methods of compliance when we perform our SBEM calculations and closely work with the design team to ensure this process is adhered to.

Please be aware the Building Control Officer or Approved Inspector may demand for a re-submitted SBEM Calculation if any changes are made between the design stage and the as-built stage.
